Property Listing Agreement
This Property Listing Agreement ("Agreement") is entered into between you, the property owner or authorized representative ("Owner"), and Illuminate Productions Inc., a corporation incorporated under the laws of Alberta, operating as CINERA ("CINERA", "we", "us", or "our"). By submitting a property listing or clicking to accept this Agreement, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, do not submit a listing.
This Agreement applies to property owners and authorized representatives throughout Canada. CINERA operates as a national platform connecting property owners with verified film and television productions.
1. Listing License
1.1 Grant of License
By submitting a property listing, you grant CINERA a non-exclusive, royalty-free, worldwide license to:
- Display your listing, including photographs, descriptions, and property details, on the CINERA platform and related applications
- Include your property in location packages and search results shared with verified film, television, and commercial productions
- Share your listing information with licensed film commissions and accredited location scouts searching for properties on behalf of productions
- Use listing photographs in promotional materials for the CINERA platform itself, including display on CINERA’s website, social media channels, and marketing materials describing the platform’s services
- Include listing photographs in film commission look books, trade show display materials, and regional marketing packages produced by participating film commissions in partnership with CINERA, for the purpose of attracting film and television productions to scout in the applicable region. These materials are distributed to production companies and creative teams at industry events and through commission channels. Your property’s photographs may appear in such materials without further notice to you beyond this Agreement. Your exact address, personal contact information, and other restricted details are never included in look book materials — only the photograph and general area descriptor are used
- These promotional uses do not extend to any individual production’s own marketing, advertising campaigns, or creative materials. Use of your property in a specific production’s marketing requires your separate written consent and is negotiated directly between you and the production
- Cache, resize, and optimize your photographs for display across web and mobile platforms
1.2 Duration and Termination of License
This license is active while your listing is live on the platform. When you remove your listing or terminate your account, the license to display your property to new users ends. However, CINERA may retain and continue to display your listing information and photographs within location packages that were already shared with productions prior to removal, for the duration of those packages' active periods. CINERA will not create new packages featuring your property after your listing is removed.
1.3 Your Retained Rights
You retain full ownership of your property and all photographs you submit. This Agreement does not transfer any ownership rights to CINERA. You may list your property on other platforms simultaneously.
2. Owner Representations and Warranties
By listing your property, you represent, warrant, and covenant on an ongoing basis that:
- You are the legal owner of the property, OR you have current written authorization from the legal owner to list the property and enter into this Agreement on their behalf
- You have the legal right to grant access to the property for scouting and filming purposes, subject to any conditions you set
- You own, or hold sufficient rights to, all photographs and media submitted with the listing, and have the right to grant CINERA the license described in Section 1
- All information provided in the listing is accurate, complete, and not misleading, and you will promptly update your listing if any information changes
- The property is lawfully permitted for its stated use and you are not aware of any legal, regulatory, strata, condominium, or HOA restrictions that would prohibit filming at the property
- Your listing and the performance of this Agreement do not violate any applicable law, regulation, lease, contract, or third-party right
3. Privacy and Address Protection
3.1 Address Visibility
Your exact property address will not be publicly displayed on the CINERA platform unless you explicitly enable this option in your listing settings. By default, only the general area (city and neighbourhood) is shown to users browsing the platform.
3.2 When Address is Shared
Your exact address will only be shared with a production after:
- The production submits an inquiry about your property
- You review and approve their inquiry through your account
- The production has been verified by CINERA or a participating film commission
3.3 Contact Information
Your personal contact information (email address, phone number) is only shared with productions you have individually approved. All initial communication is facilitated through the CINERA platform.
3.4 Data Protection
CINERA collects and processes your personal information in accordance with our Privacy Policy and applicable Canadian privacy legislation, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws. By entering into this Agreement, you acknowledge and consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.
4. No Guarantee of Inquiries or Bookings
CINERA makes no representation, warranty, or guarantee that:
- Your property will receive any inquiries, bookings, or rental income
- Your listing will appear in any specific search result, ranking, or location package
- Any production that contacts you will proceed with a booking or honour any agreement they enter into with you
- The platform will be continuously available or that your listing will be visible at all times
CINERA is a marketplace platform. Results depend on production demand, location needs, and factors outside CINERA's control. Listing your property is not a guarantee of income.
5. Production Agreements
5.1 CINERA's Role
CINERA is a technology platform that facilitates introductions between property owners and film and television productions. CINERA is not a party to, and accepts no responsibility for, any rental, location, or filming agreement you negotiate directly with a production. We do not participate in negotiations, set rental rates, or guarantee the conduct of any production.
5.2 Owner Responsibilities
When engaging with productions, you are solely responsible for:
- Negotiating and executing a separate location or filming agreement with appropriate terms directly with the production
- Verifying the production's liability insurance coverage meets your requirements before granting access to your property
- Collecting payment directly from the production (CINERA does not process payments between owners and productions)
- Ensuring any filming activities comply with local municipal regulations, HOA or strata bylaws, lease restrictions, and any other applicable requirements
- Conducting your own due diligence on the production company and its representatives
5.3 Verified Productions
CINERA verifies productions through film commissions and internal screening processes. Verification confirms a production's identity and basic legitimacy but does not constitute an endorsement, creditworthiness assessment, or guarantee of the production's conduct.
6. Fees and Subscription
6.1 Listing Fee
Property listings require a monthly subscription of $14 CAD per month (plus applicable taxes) to remain visible on the platform. This fee covers:
- Unlimited photo and media storage for your listing
- Inclusion in search results and participating film commission databases
- Inquiry management and communication tools
- Owner dashboard access
6.2 No Commission
CINERA does not charge any commission or fee on rental income you negotiate directly with productions. You retain 100% of any rental fees you agree to.
6.3 Subscription Cancellation
If you cancel your subscription or it lapses due to non-payment, your listing will be hidden from the platform but your account data and listing content will be retained for 90 days. You may reactivate your listing within this period by resuming your subscription. After 90 days of inactivity, your listing content may be permanently deleted.
6.4 Fee Changes
CINERA may change subscription fees upon 30 days' written notice by email. Your continued use of the platform after the effective date of a fee change constitutes acceptance of the new fee.
7. Termination
7.1 Termination by Owner
You may remove your listing at any time by:
- Setting your listing to "Inactive" in your account settings
- Cancelling your subscription through your account billing settings
- Contacting CINERA support to request removal
- Deleting your account entirely
Removing your listing does not entitle you to a refund of any prepaid subscription fees for the current billing period.
7.2 Termination by CINERA
CINERA reserves the right to suspend or permanently remove listings, with or without notice, that:
- Violate this Agreement, our Terms of Service, or applicable law
- Contain inaccurate, misleading, or fraudulent information
- Receive substantiated complaints from productions
- Are for properties subject to restrictions that prohibit commercial filming
- Are associated with accounts engaged in abuse, fraud, or harassment
7.3 Effect of Termination
Upon termination of this Agreement for any reason, CINERA's license to display your listing to new users ends as described in Section 1.2. Sections 2, 8, 9, 10, 11, 12, and 13 survive termination.
8. Limitation of Liability
8.1 No Liability for Filming Activities
CINERA is not liable for any loss, damage, injury, or expense arising from or related to filming activities at your property, including but not limited to:
- Physical damage to your property or its contents during filming
- Personal injury to any person occurring at your property during filming
- Disputes over rental terms, payment obligations, or contractual performance between you and any production
- Failure of any production to honour agreed terms or make payment
8.2 General Limitation
To the maximum extent permitted by applicable law, CINERA's total aggregate liability to you for any claim arising out of or related to this Agreement or your use of the platform shall not exceed the total subscription fees paid by you to CINERA in the twelve (12) months immediately preceding the event giving rise to the claim. CINERA is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly.
8.3 Platform Availability
CINERA provides the platform "as is" and "as available." We do not warrant that the platform will be uninterrupted, error-free, or secure at all times. Planned and unplanned maintenance, third-party outages, and events beyond our control may affect availability.
9. Indemnification
You agree to indemnify, defend, and hold harmless CINERA, Illuminate Productions Inc., and their respective officers, directors, employees, contractors, and agents from and against any and all claims, actions, proceedings, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your listing content, property information, or photographs
- Any breach of your representations, warranties, or obligations under this Agreement
- Your interactions with productions or other platform users
- Any filming activities at your property
- Any claim that your listing content infringes a third party's intellectual property rights
10. Governing Law and Jurisdiction
This Agreement is governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles. This Agreement applies to property owners and listings throughout Canada.
Any dispute arising out of or in connection with this Agreement that cannot be resolved through good-faith negotiation shall be subject to the exclusive jurisdiction of the courts of the Province of Alberta. You irrevocably consent to the personal jurisdiction of such courts.
Nothing in this section limits any rights you may have under mandatory applicable consumer protection legislation in your province of residence.
11. Changes to This Agreement
CINERA may update this Agreement from time to time. For material changes, we will provide at least 30 days' notice by email to the address associated with your account and by updating the version number and effective date at the top of this page. For non-material changes (such as clarifications, corrections, or updates to contact information), changes may take effect immediately upon posting.
Your continued use of the platform after a material change takes effect constitutes your acceptance of the updated Agreement. If you do not agree to a material change, you may remove your listing and terminate your account before the change takes effect.
The version number and effective date at the top of this page identify the Agreement you accepted. CINERA maintains records of the version accepted by each user at the time of listing submission.
12. General Provisions
12.1 Entire Agreement
This Agreement, together with CINERA's Terms of Service and Privacy Policy, constitutes the entire agreement between you and CINERA with respect to your property listing and supersedes all prior or contemporaneous agreements, representations, or understandings, whether written or oral, relating to its subject matter.
12.2 Severability
If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of this Agreement shall continue in full force and effect.
12.3 Waiver
CINERA's failure to enforce any right or provision of this Agreement shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of CINERA to be effective.
12.4 Assignment
You may not assign or transfer your rights or obligations under this Agreement without CINERA's prior written consent. CINERA may assign this Agreement, in whole or in part, without restriction, including in connection with a merger, acquisition, or sale of assets.
12.5 Force Majeure
Neither party shall be liable for any delay or failure to perform its obligations under this Agreement due to circumstances beyond its reasonable control, including acts of God, natural disasters, government actions, labour disputes, power failures, or telecommunications outages.
12.6 Language
The parties have expressly requested that this Agreement and all related documents be drafted in English. Les parties ont expressément demandé que la présente entente et tous les documents connexes soient rédigés en anglais.

Acknowledgment
This is Version 2.1 of the CINERA Property Listing Agreement, effective April 30, 2026.
BY SUBMITTING A PROPERTY LISTING OR CLICKING TO ACCEPT, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THIS AGREEMENT IN ITS ENTIRETY AND AGREE TO BE LEGALLY BOUND BY ITS TERMS. IF YOU ARE ENTERING INTO THIS AGREEMENT ON BEHALF OF A PROPERTY OWNER, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND THAT PERSON TO THESE TERMS.
